Terms of Service

1. Agreement to Terms

By accessing or using PingLocal ("the Platform"), operated by PingLocal (Pty) Ltd, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

PingLocal provides a WhatsApp Business API automation platform that enables businesses to send and receive WhatsApp messages, manage customer conversations, run broadcast campaigns, build automated message flows, and track messaging analytics. The Platform operates through Meta's WhatsApp Business API.

3. Account Registration

  • You must be 18 years or older and a registered business to use PingLocal.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete registration information.
  • One PingLocal account may connect one or more WhatsApp Business phone numbers.

4. Acceptable Use

You agree not to use PingLocal to:

  • Send spam or unsolicited messages to people who have not opted in
  • Violate Meta's WhatsApp Business Policy or Commerce Policy
  • Send messages containing illegal, harmful, or misleading content
  • Attempt to circumvent WhatsApp's messaging limits or rate controls
  • Use the Platform for any illegal purpose or in violation of South African law
  • Resell or redistribute access to the Platform without written permission

5. Pricing & Payment

  • PingLocal charges a monthly subscription fee of R200/month for platform access.
  • WhatsApp conversation costs are charged separately based on Meta's per-conversation pricing (marketing ~R0.50, utility ~R0.30, authentication ~R0.20).
  • Subscriptions are billed monthly in advance. WhatsApp API costs are billed based on actual usage.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

6. WhatsApp Business API Terms

Your use of WhatsApp through PingLocal is also governed by Meta's WhatsApp Business Terms of Service. PingLocal is a Business Solution Provider (BSP) that facilitates your access to the WhatsApp Business API. You are responsible for ensuring your use complies with WhatsApp's policies, including obtaining proper opt-in consent from message recipients.

7. Data Ownership

  • You retain ownership of your contact data, message content, and business information.
  • PingLocal has a limited license to process your data solely for the purpose of providing the service.
  • You can export your data or request deletion at any time.

8. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. The Platform depends on third-party services including Meta's WhatsApp Business API, which may experience downtime outside our control. We will communicate known outages through our status channels.

9. Limitation of Liability

PingLocal is provided "as is". To the maximum extent permitted by South African law, PingLocal (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including lost revenue from undelivered messages or WhatsApp API disruptions.

10. Termination

We may suspend or terminate your account if you violate these Terms, Meta's policies, or applicable law. Upon termination, your access to the Platform will cease and your data will be handled in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of the Western Cape, South Africa.
